1. Agreement

SamePoints is operated by Xiang Zheng (Lance), sole trader, trading as SamePoints (ABN 11 359 038 061).

These Terms govern your access to and use of SamePoints. By using the service, you agree to these Terms on behalf of your business. If you do not agree, do not use the platform.

2. Service scope

SamePoints helps merchants operate loyalty programs across Shopify and Square. Features may change over time as we improve the product, provided material changes are communicated in-app or by email.

SamePoints is a software tool only. We are not a bank, payment institution, or promoter of your loyalty scheme. You are responsible for the rules, disclosures, and compliance of your rewards program with your customers.

3. Account responsibilities

  • Provide accurate account information and keep credentials secure.
  • Use the service in compliance with applicable law and platform terms.
  • Do not misuse APIs, reverse engineer restricted components, or disrupt service availability.

4. Billing and subscriptions

Paid plans, if applicable, are billed in advance on the cycle shown at checkout. Fees are generally non-refundable except where required by law (including the Australian Consumer Law). You can cancel future renewals at any time from account settings.

5. Data and integrations

You are responsible for obtaining permissions needed to connect Shopify, Square, and other systems. You retain ownership of your data. We process data under your instructions and as described in our Privacy Policy.

6. Suspension and termination

We may suspend or terminate accounts that materially breach these Terms or create security risk. You may stop using SamePoints at any time. Upon termination, access to the service may be disabled after a reasonable export period.

7. Disclaimers

SamePoints is provided on an as-is and as-available basis. We do not guarantee uninterrupted operation, specific revenue outcomes, or compatibility with third-party services beyond documented integrations.

8. Limitation of liability

To the maximum extent permitted by law (including the Australian Consumer Law where applicable), neither party is liable for indirect or consequential losses. Aggregate liability for claims related to the service is limited to fees paid in the 12 months preceding the event giving rise to the claim.
